年モントリオール第四議定書は、運送人が故意または故意に相当する過失によって貨物を滅失・毀損させても条約上の賠償限度額を援用できるという絶対的賠償限度額を採用した。この絶対的賠償限度額は我が国を含む大陸法系の国にとっては国内法秩序に反することから批准が困難であったが、その後多くの国々に支持され、現行の1999
